Terms of Service
These terms govern the use of Bima (bima.live) - by the organizations that order it, their team members, and the viewers who enter broadcasts. Using the service means agreeing to them.
1. The service
Bima provides a secure live-broadcast platform: a console for broadcasts, team and viewers; viewer entry by code; a player with a personal watermark; recording; an audit log. The service is provided as is and we improve it continuously. Features marked "coming" are not part of the commitment until available.
2. Accounts and team
A staff account is opened by invitation from the organization or the platform. You are responsible for your password and two-factor means, and for reporting unauthorized use immediately. An organization manager is responsible for whom they invite and which broadcasts they assign operators to.
3. Content and the organization's responsibility
Broadcast content, recordings and viewer lists belong to the organization and are its responsibility. The organization represents that it holds the rights and consents needed to broadcast the content, register the viewers and record - including notice to viewers about the watermark and parental consent for minors.
It is forbidden to broadcast unlawful content, content infringing others' rights, or content contrary to the platform's content policy. The platform keeps a list of forbidden topics set by the operator; a broadcast or organization touching them may be refused automatically, flagged for review, or suspended. The platform operator's decision on this is final.
4. Viewers
A viewing code is personal or shared as the organization decided. Do not pass a personal code to others, record or redistribute the broadcast, or circumvent player protections. A personal watermark is applied to the screen; entering with the code is consent to it. The organization may disconnect a viewer or revoke a code at any time.
5. Acceptable use
- No harassment, incitement, fraud, or harm to others.
- No attempts to access another organization's data, bypass permissions, or perform penetration testing without written approval.
- No deliberate overloading of the service or use contrary to the law in your country.
- We may suspend an organization or account that breaches these terms, and in severe cases terminate the service. Suspension is recorded in the organization's audit log.
6. Fees
Rates are in the price list or the offer you received. Prices in the price list are in Israeli shekels and exclude VAT, which is added as required by law.
Billing works in two ways: topping up a balance by card or PayPal from the billing screen in the console, from which usage is drawn at price-list rates; or under a written agreement between the organization and Bima. Every payment produces a numbered tax invoice, downloadable in the console.
Quotas (concurrent viewers, parallel broadcasts, streaming hours and the recording retention window) are part of the plan or package and are shown in the organization's settings. Exceeding the viewer quota blocks further viewers from entering; it never bills automatically.
7. Cancellation and refunds
A monthly plan is a continuing transaction: you may cancel it at any time from the console or by contacting us, and cancellation takes effect at the end of the billing period already paid for. We charge nothing after the cancellation date, and the remainder of the paid period stays available to use.
Single-event packages: cancel up to 7 days before the event date set in the system for a full refund. Cancelling between 7 days and 48 hours before the event refunds 50%. Within 48 hours of the event there is no refund, because the resources - a media node, a compositor machine and edge capacity - have already been reserved for it.
A topped-up balance that was never used is refunded on request to the original payment method, less processing fees already incurred, within 14 business days.
If you are a consumer under Israel's Consumer Protection Law, 5741-1981, the statutory cancellation rights - including cancelling a distance sale within 14 days of the transaction or of receiving the disclosure document, provided the cancellation is at least two business days before the service begins - apply in addition to the above and prevail over it in any conflict. Cancellation fees are charged only at the rate the law sets.
Cancellation and refund requests are sent from the organization manager's registered email address. We confirm receipt in writing and respond within 14 business days.
If we cancel the service for reasons other than a breach by you, we refund the proportional amount for the period or event not delivered.
8. Availability and support
We aim for high availability and announce planned maintenance in advance when possible. The service relies on cloud providers and networks not fully under our control. No absolute availability commitment applies unless a separate SLA is signed.
9. Intellectual property
The platform, code, design and the Bima brand are ours. Broadcast content, recordings and the organization's data are the organization's. You grant us a limited license to store, process and transmit the content only to provide the service.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for the service is limited to the amount paid to us by the organization in the 12 months preceding the event. We are not liable for indirect damage, lost revenue, or content that organizations or viewers broadcast or distribute. Nothing here limits liability that cannot be limited by law.
11. Termination
An organization may stop using the service at any time and request data deletion per the privacy policy. We may terminate with reasonable notice, or immediately for a material breach. The audit log is kept per the privacy policy after termination.
12. Law and jurisdiction
Israeli law governs, with exclusive jurisdiction of the competent courts in Jerusalem. If you are a consumer in a country granting non-waivable protections, those are preserved.
13. Changes to the terms
We update these terms from time to time. A material change is communicated to organizations by email or in the console at least 14 days in advance. Continued use after the effective date is acceptance.
14. Paid viewing tickets
1. The seller. A paid viewing ticket is sold by Bima Live Broadcast (במה שידור חי), Israeli dealer no. 066669011, 95 Etrog St., Givat Ze'ev, Israel, phone +972-52-564-0054, email main@bima.live ("Bima"). Bima issues the receipt for the payment. The organisation named on the broadcast is the event organiser and is responsible for the broadcast's content and schedule.
2. What is sold. A personal viewing code for a specific live broadcast at its scheduled time. The code is for the buyer only, allows viewing on one device at a time, and may not be transferred or resold. Viewing carries a personal watermark. Bima may block a code that was passed on or used outside these terms, without refund.
3. Delivery. The code is shown on screen as soon as the payment is confirmed and is emailed to the address given at purchase. A buyer who did not receive the code writes to main@bima.live and receives it again at no charge.
4. Price and payment. The price is stated in US dollars and includes VAT where it applies. Payment is made in one instalment through PayPal. Conversion to the buyer's currency is done at the rate of PayPal or the card issuer and is outside Bima's control.
5. Cancellation by the buyer. The buyer may cancel by written notice to main@bima.live, stating the purchase email and the broadcast name, within 14 days of the purchase, provided the notice reaches Bima at least two business days before the broadcast. Bima then refunds the payment to the payment method used, within 14 days of receiving the notice, less a cancellation fee of 5% of the ticket price or ILS 100, whichever is lower. No fee is charged when the cancellation is due to a defect or a discrepancy between the service and the details provided. Once the broadcast has started the service has been rendered and can no longer be cancelled.
6. Cancellation by the organiser, or a failure. A broadcast cancelled by the organiser, moved to a date the buyer does not accept, or not held because of a failure on Bima's side is refunded in full, with no fee, within 14 days. A partial failure during the broadcast is reviewed on written request, and Bima decides on a full or partial refund according to the failure's length and cause.
7. Recording and distribution. Recording, filming, rebroadcasting or distributing the broadcast or any part of it is prohibited. The personal watermark identifies the source of a leak, and the organiser's and Bima's rights in the content are reserved.
8. Personal details. The name and email given at purchase are used to issue and send the code, for the receipt and for handling cancellations, and are kept under Bima's privacy policy. Payment details are held by PayPal only.
